Fire Safety Obligations:
What Fresno Property Owners Must Know
California has some of the most specific fire safety requirements for rental properties in the United States β and Fresno landlords who aren't current with these obligations face real legal and financial exposure. Smoke Detector Requirements for Rentals
California Civil Code Β§1941.2 requires landlords to install and maintain working smoke detectors in all rental dwelling units. The specific requirements:
- Smoke detector required inside each sleeping room
- Smoke detector required outside each sleeping area
- Smoke detector required on each level of the dwelling, including basements
- For buildings with four or more units built or substantially renovated after 2014: hardwired, interconnected smoke alarms with battery backup required
- Landlords must provide working smoke detectors at the start of each tenancy
- Landlords must maintain detectors in working condition and respond to tenant repair requests
Carbon Monoxide Detector Requirements
California Health & Safety Code Β§17926 (the Carbon Monoxide Poisoning Prevention Act) requires CO detectors in all dwelling units that have:
- An attached garage
- A fossil fuel-burning heater or appliance (gas furnace, water heater, dryer, stove)
- A fireplace of any type
This covers the overwhelming majority of Fresno rental units β nearly every Central Valley home with a gas water heater or furnace qualifies. CO detectors must be installed in or near each sleeping area. In our inspections, we find non-compliant CO detector status in 57% of Fresno properties.
Fire Extinguisher Requirements
California requires fire extinguishers in certain commercial occupancies and multi-family common areas. Requirements for single-family rentals are less prescriptive at the state level, but best practice β and Fresno City Code for certain property types β recommends at minimum one 2.5-lb ABC extinguisher on each level and in the kitchen area. Check with the Fresno City Fire Department for requirements specific to your property type and classification.
Fresno City-Specific Requirements
The City of Fresno Fire Department conducts periodic inspections of multi-family properties. Fresno has adopted the California Fire Code with local amendments. Properties with five or more units face additional requirements for common area emergency lighting, fire department access, and fire sprinkler systems in buildings over three stories. Single- and two-family rentals are primarily governed by state law rather than city fire code inspection programs.
Documentation Best Practices for Fresno Landlords

- Retain a dated inspection record for each unit showing smoke and CO detector status at move-in
- Respond to all tenant maintenance requests in writing and retain copies
- Conduct annual fire safety checks and retain written records
